We, the Stiefmüller Hohenauer & Partner GmbH, consulting engineers, Mühlbachweg 8, 6250 Kundl, SHP in short, would like to inform you at this point about the processing of your personal data in the framework of the General Data Protection Regulation (DSGVO / GDPR), the Data Protection Act (DSG / DPA)) and the Telecommunications Act (TKG).

Personal data and purposes of processing
Personal data is any data that contains information about personal or material circumstances, such as name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photos, etc.
We collect, process and use your personal data only if this is necessary for the fulfillment of the contract or due to a legal obligation or if you voluntarily provide us with this data. For data processing beyond this, we obtain your consent before processing the data. If our interest in data processing legitimately outweighs the interest in data protection, the processing may also take place without your consent.
We will use the data made available to us in particular for the purpose of fulfilling the contract, initiating an agreement, fulfilling legal obligations, for internal marketing purposes and for internal marketing purposes.

Data processing when contacting

As a data subject, you have the right at any time to obtain information about your stored personal data, their origin and recipient and the purpose of data processing, as well as a right to rectification, data transfer, opposition, restriction of processing and blocking or deletion of incorrect or inadmissibly processed data. You have the right at any time to revoke your consent to the use of your personal data.
If you believe that the processing of your personal data by us violates the applicable data protection law, it is possible to complain to the competent supervisory authority. In Austria, the data protection authority is responsible for this. The protection of your personal data takes place through appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, unlawful or accidental access, processing, loss, use and manipulation.
Notwithstanding compliance with a reasonable standard of care, it cannot be ruled out that personal data may be viewed and used by other persons. Please note that we therefore accept no liability whatsoever for the disclosure of information due to non-caused errors in data transmission and / or unauthorized access by third parties (eg hacking on email account or telephone, interception of faxes).
Transmission of data to third parties
SHP transmits your data to third parties, if we are legally obliged to transmit. Furthermore, we will transfer your data to third parties, provided that you have consented to the transfer to third parties, for example, in the context of an agreement with us or the third party, or the data transmission to fulfill our contract with you is required, such as in the case of data transmission to a project working professionals, construction supervision, other specialist planners or the like.
In addition, to fulfill our contractual or legal obligations, it may be necessary to transfer your data to the processor. Processors process your personal information in a directive-bound manner and only to the extent necessary to perform these tasks. Our processors, for example, are tax consultants, IT service providers or other external service companies, etc. If necessary, we will seek your consent before submitting your data.
However, we only transfer your personal data to recipients within the European Union or to countries for which the EU Commission has decided that they have an appropriate level of data protection.
Collection of basic access data
Based on our legitimate interests within the meaning of Art. 6 para. 1 lit. f. DSGVO / GDPR we collect data about every access to the server on which this service is located. The access data includes the name of the retrieved website, the date and time of the retrieval, browser type and version, the user´s operating system, referrer URL (the previously visited page), host name of the user´s computer (IP address). Log file information is stored for security purposes (for example, to investigate abusive or fraudulent activities) for a maximum of 14 days and then deleted. Data whose further retention is required for evidential purposes shall be exempted from the cancellation until final clarification of the incident.
Storage of data
SHP will not retain data for longer than is necessary to fulfill our contractual or legal obligations and to enforce or defend against any claims, in particular liability claims.
Our website uses features of the web analytics service Google Analytics, a web analytics service provided by Google Inc. (1600 Amphitheater Parkway Mountain View, CA 94043, USA). The data processing takes place on the basis of the legal regulations of the § 96 Abs 3 TKG as well as the art 6 Abs 1 a) (consent) and / or f (legitimate interest) of the DSGVO / GDPR. Since the privacy of our users is important to us, the user data is pseudonymised.
Google Analytics uses so-called cookies, text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated thereby is transmitted by Google in the USA and stored there. You can prevent this by setting up your browser so that no cookies are stored or set the appropriate cookie control. We have concluded a corresponding contract data processing contract with the provider.
Your IP address is captured but immediately pseudonymised. As a result, only a rough localization is possible. Your IP address will be truncated by Google within the European Union or in another state party to the Agreement on the European Economic Area and thereby made anonymous. The last 8 bits of an IPv4 address are set to 0, with an IPv6 address the last 80 of the 128 bits. The user data is kept for a period of 14 months.
Establishment of services and third parties
Within our online offer, SHP relies on our legitimate interests in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. DSGVO / GDPR third-party content or service offerings in order to provide their content and services, e.g. include videos or fonts (collectively referred to as content). The condition is that the third-party providers of this content, the IP address of the users perceive, because they could not send without the IP address, the content to their browser. Therefore, the IP address is required for the presentation of this content. SHP endeavors to use only those services whose respective providers only use the IP address to deliver the content. Furthermore, these third parties may use so-called pixel tags for statistical or marketing purposes. Through the pixel tags can be information, such as the traffic to the page.
The pixel tags can be used to evaluate information such as visitor traffic on the pages of this website. The anonymized information can also be stored in cookies on the device of the user. External fonts from Google, Inc., https://www.google.com/fonts (Google Fonts). The integration of Google fonts is done by a server call on Google (usually in the US).
